BEN DE LEON AND GEORGE B. WARD SECURE VICTORY IN FEDERAL COURT
FOR INTERNATIONAL CLIENT

On April 21, 2010, the law firm of De Leon & Washburn, PC obtained a swift victory for a corporate client located outside of the United States.  The corporate client, who specializes in providing financial and tax consulting services, was sued in a Texas Federal Court in March of 2010.  The serious allegations made against the client included fraudulent inducement, breach of contract, fraudulent misrepresentation, and an action for declaratory judgment.  After initially responding to the lawsuit, attorneys Ben De Leon and George B. Ward quickly filed a motion to dismiss the lawsuit.  In the motion to dismiss, Mr. De Leon and Mr. Ward argued to the Court that a valid venue selection clause precluded the Plaintiffs from suing the corporate client in the Texas Federal Court.  After further briefing from the attorneys, the Federal Court agreed that the action against the client was barred by the contractual venue provision, and dismissed the lawsuit.  The quick victory, obtained less than two months from the initial filing of the lawsuit, allowed the corporate client to avoid the costly and protracted litigation that so often occurs in complex corporate matters.
